INSPECTIONS AND OTHER INFORMATION DURING CLOSURE FOR CORONAVIRUS PANDEMIC

Note: this update includes information related to requesting 6-month extension to Building Permits and Delelopment Orders.

In order to ensure the safety of our customers and employees during this coronavirus pandemic, Islamorada, Village of Islands, Building Department (the Department) is closed for permitting, plan review and inspections for seven (7) days starting March 24, 2020 through March 30, 2020 and re-evaluated every seven (7) days. THE CLOSURE IS NOW EXTENDED THROUGH APRIL 19, 2020 and will continue to be evaluated. 

UPDATED INFORMATION:
Governor signs Executive Order extending permit 6 months.

Governor DeSantis issued Executive Order Number 20-52 on March 9, 2020 declaring a state of emergency because of COVID-19 which allows the Building Official to extend Building Permits and the Planning Director to extend Development Orders.

 All Building Permits and Development Orders active on March 9, 2020 are eligible to receive a 6-month extension. The permit holder is required to submit a 6-month Building Permit Extension Application.

Development Orders:
All Development Orders active on March 9, 2020 are eligible for a 6-month extension.  This includes the following types of approvals:
 
  • Conditional Use Permits
  • Development Agreements
  • Lot Line Adjustments

No changes were made to the following information that was included in the first memorandum.

During this time, only electronic building permit applications will be processed, reviewed, and issued.  In addition, the Department will not be conducting inspections during this time frame.  In order to offer the ability for existing permitted work to continue, we have three alternatives available for inspections:

  • PROFESSIONAL ENGINEERS
  • ARCHITECTS
  • PRIVATE PROVIDERS

The Building Official hereby requests that Professional Florida Engineers and Architects provide inspection services only for job sites with active existing permits for purposes of satisfying F.S. 471.045 and 481.222, if owners choose this option. Private Providers may also offer inspection services if owners choose this option.

PROFESSIONAL ENGINEERS

A professional engineer may provide building code inspection services as described in F.S. 471.045 until the Department resumes normal operations.

Fs. 471.045 Professional engineers performing building code inspector duties.  – Notwithstanding any other provisions of law, a person who is currently licensed under this chapter to practice as a professional engineer may provide building code inspection services described in s.468.603(5) and (8) to a local government or state agency upon its request, without being certified by the Florida Building Code Administrators and Inspectors Board under part XII of chapter 468.  When performing these building code inspection services, the professional engineer is subject to the disciplinary guidelines of this chapter and s.468.621(1)(c)-(h).  Any complaint processing, investigation, and discipline that arise out of a professional engineer’s performing building code inspection services shall be conducted by the Board of Professional Engineers rather than the Florida Building Code Administrators and Inspectors Board.  A professional engineer may not perform plans review as an employee of a local government upon any job that the professional engineer or the professional engineer’s company designed.

An affidavit of inspections will be required to be submitted via email to sheila.denoncourt@islamorada.fl.us. Followed by US Mail, with original signature and seal to:

ARCHITECTS
A person who is currently licensed to practice as an architect may provide building code inspection services as described in F.S.481.222, until the Department resumes normal operations.

F.S.481.222 Architects performing building code inspection services. - Notwithstanding any other provision of law, a person who is currently licensed to practice as an architect under this part may provide building code inspection services described in s.468.603(5) and (8) to a local government or state agency upon its request, without being certified by the Florida Building Code Administrators and Inspectors Board under part XII or chapter 468.  With respect to the performance of such building code inspection services, the architect is subject to the disciplinary guidelines of this part and s.468.621(1) (c)-(h). Any complaint processing, investigation, and discipline that arise out of an architect’s performance of building code inspection services shall be conducted by the Board of Architecture and Interior Design rather than the Florida Building Code Administrators and Inspectors Board.  An architect may not perform plans review as an employee of a local government upon any job that the architect or the architect’s company designed.

PRIVATE PROVIDERS
F.S.553.791(5)  After construction has commenced and if the local building official is unable to provide inspection services in a timely manner, the fee owner or the fee owner’s contractor may elect to use a private provider to provide inspection services by notifying the local building official of the owner’s or contractor’s intention to do so, two (2) business days before the next scheduled inspection.

  1. For active building permits, without a previously appointed private provider, a private provider may be assigned once the conditions of F.S.553.791(5) are met.  The “Notice to the Building Official of Use of Private Provider” and other forms must be submitted via email.
  2. The “Private Provider Inspection Report” must be submitted with each inspection via email. A “Private Provider Certificate of Inspections/Compliance” form will be required for final inspections.
  3. Private Providers are required to provide inspection documentation and compliance reports that can be emailed followed by mailed originals to the Village at:

PLANNING and BIOLOGICAL Inspections:

The Planning and Biological Department inspections may not be conducted by an Engineer, Architect, or Private Provider.

Work on an active permit may NOT proceed if a Pre-Development Biological Inspection is required as identified on your permit conditions and issued permit card and was not completed by the Village Biologist prior to the closure of the Village offices.  If a job hasn’t started it is on hold.

Other BIOLOGICAL and PLANNING inspections are on hold until office re-open.

FLOOD Inspections

The Flood Department inspections may not be conducted by an Engineer, Architect, or Private Provider.  Village staff will complete inspections when staff returns.

A policy to extend permits that expire during this time will be made when normal business resumes. We will continue to monitor this situation and keep you informed as events evolve.
